2. Data Collection: Personal Information

We collect and process personal information you make available to us if you register, download or use the Services:

• Account Data: Name, Email Address, Mailing Address, Phone Number, Username, Password.
• User-Generated Content (UGC) & AI Inputs: Data you provide to generate designs, including text prompts used for AI generation and uploaded reference images.
• Financial Info: Information to process payments or payouts.
• Interests & Preferences: Favorites, interests, and transaction details.

3. Data Collection: Automatically Collected

We automatically collect:

• Device Data: Device type, advertising ID, IP address, OS, browser type.
• We use the Sensors SDK to collect your IDFA IDFV information for statistical analysis of your use in the App.
• Affiliate Tracking Data: Information regarding referring URLs (e.g., when you are referred by an affiliate partner) to calculate commissions.
• Usage Data: Pages viewed, time spent, and interaction with features.
• Location Data: Imprecise location inferred from IP address (Country, State, City).

4. Information We Collect from Third Parties

We may combine information we collect with information from third-party sources (data aggregators, marketing partners) to tailor communications and improve services.

5. How We Use Your Personal Information

We use your data to:

• Provide, improve, and personalize our Services (including AI generation features).
• Process payments and fulfill orders.
• Calculate Affiliate Commissions: Track referrals to ensure accurate payouts to partners.
• Carry out marketing activities and promotions (with consent where required).
• Detect and prevent fraud (e.g., self-referrals).

6. Advertising and Analytics

We work with third-party advertisers and analytics companies. We may share hashed/pseudonymized data (like email or ad IDs) to serve targeted ads ("Matched Ads"). You can opt-out of these as described in Section 12 & 13.

7. Third Parties to Whom We Disclose Information

We disclose information to:

• AI Service Providers: Text prompts and images are sent to AI models to generate designs.
• Service Providers: Payment processors, hosting, shipping partners.
• Advertisers & Marketing Companies: For targeted advertising.
• Affiliates: To facilitate joint content and services.
• Legal Authorities: When required by law or to protect rights.

8. Cookies and Tracking Technologies

We use cookies, pixel tags, and SDKs to operate our Services, analyze performance, and facilitate affiliate tracking. You can control these via the "Cookie Settings" link on our website or browser settings (including Global Privacy Control).

Do Not Track (DNT): Please note that we generally do not respond to "Do Not Track" signals sent by web browsers, as there is no consistent industry standard for compliance.

9. Age Restriction & Children's Privacy

Age Restriction: Our Services are not intended for or directed to individuals under the age of 18. By using the App, you represent that you are at least 18 years of age.

We do not knowingly collect personal data from children under 18. If we become aware that a child has provided us with personal data, we will take steps to delete such information immediately. If you believe we might have any information from a child, please contact us.

10. Nevada Privacy Rights

Nevada residents may opt-out of the sale of "covered information".

11. California Privacy Rights

California residents (CCPA/CPRA) have rights to know, correct, delete, and opt-out of the "sale" or "sharing" of personal information. We do not knowingly sell info of minors under 16.

12. CO, CT, UT, and VA Privacy Rights

Residents of these states have rights to access, correct, delete, and opt-out of targeted advertising and sales of data.

13. Data Security and Storage

We implement appropriate technical and organizational measures (such as encryption and access controls) to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet is 100% secure.

14. SMS Privacy Policy

If you opt-in to SMS, we may send promotional messages. You can reply "STOP" to opt-out. Mobile carrier fees may apply.

15. Updates to this Privacy Notice

We may modify this notice at any time. Continued use of Services constitutes acceptance.

16. Remove Your Account & Personal Data

You have the right to request the deletion of your account and associated personal data at any time.

• How to Delete: You can initiate account deletion directly within the App by navigating to Settings > Delete Account. Alternatively, you may contact us via the support channels provided in the app.
• What Happens: Upon request, your profile, portfolio, and personal data will be permanently deleted from our active databases within 30 days.
• Exceptions: We may retain certain information (such as transaction history and tax records for affiliate payouts) as required by law or for legitimate business purposes (e.g., fraud prevention).
